Guanacaste Sailing Charters

1. Nature of Our Service (Booking Platform / Intermediary)

Guanacaste Sailing Charters is a local booking service and travel coordination platform that connects customers with independent sailboat and catamaran tour operators in Guanacaste, Costa Rica.

Guanacaste Sailing Charters does not own, operate, manage, captain, crew, or control any sailboats, catamarans, vessels, or marine tour operations.

Our role is limited to:

  • Checking tour availability

  • Connecting customers with independent sailing tour operators

  • Handling reservations and booking coordination

  • Providing tour recommendations based on customer preferences

  • Coordinating optional transportation services

All sailing tours and marine activities are owned and operated exclusively by independent third-party tour operators.

By booking through Guanacaste Sailing Charters, you acknowledge and agree that:

  • The tour operator is solely responsible for the operation of the vessel and the tour.

  • Guanacaste Sailing Charters acts only as a booking intermediary connecting customers with tour providers.


2. Third-Party Operator Responsibility

All sailing tours, marine excursions, and transportation services are operated by independent third-party companies.

The tour operator, vessel owner, captain, and crew are solely responsible for:

  • Vessel operation

  • Navigation decisions

  • Safety procedures

  • Crew conduct

  • Tour execution

  • Passenger safety during the activity

Guanacaste Sailing Charters assumes no responsibility or liability for:

  • Personal injury

  • Loss of life

  • Property damage

  • Accidents occurring during a tour

  • Loss or damage of personal belongings

  • Delays, cancellations, or operational issues

These matters fall entirely under the responsibility of the independent service provider operating the tour.


3. Operational Conditions Beyond Our Control

Guanacaste Sailing Charters shall not be responsible for injury, damage, loss, delay, or irregularity resulting directly or indirectly from circumstances beyond our control, including but not limited to:

  • Weather conditions

  • Ocean and navigation conditions

  • Mechanical breakdowns

  • Port authority restrictions

  • Government regulations

  • Strikes or labor disputes

  • Theft or loss of personal belongings

  • Civil disturbances

  • Failure of transportation services to operate as scheduled

  • Force majeure events or acts of God


4. Assumption of Risk

Customers acknowledge that participation in sailing tours and marine activities involves inherent risks.

These risks may include, but are not limited to:

  • Ocean conditions

  • Vessel movement

  • Weather changes

  • Swimming and snorkeling activities

  • Marine wildlife

  • Physical exertion

By booking and participating in a sailing tour arranged through Guanacaste Sailing Charters, customers voluntarily assume all risks associated with these activities.


5. Customer Responsibility

Arrival and Punctuality

Customers are responsible for arriving on time to all scheduled meeting points, tours, and transportation pickups.

Guanacaste Sailing Charters assumes no responsibility for missed tours or services due to late arrival or personal circumstances.

Missed services due to lateness may be considered “no-shows” and may not be refundable.


Customer Conduct

Tour operators reserve the right to remove or refuse participation to any person whose behavior is considered:

  • Dangerous

  • Disruptive

  • Aggressive

  • Intoxicated

  • Disrespectful toward crew or other passengers

No refunds will be issued in these situations.


6. Transportation Services

Transportation services arranged through Guanacaste Sailing Charters are operated by independent third-party transportation providers.

Customers must arrive at least 10 minutes prior to the scheduled pickup time.

Guanacaste Sailing Charters shall not be responsible for:

  • Missed transportation services

  • Delays caused by third-party operators

  • Additional expenses resulting from missed pickups


7. Operator Permits and Insurance

Sailing tours operating within Costa Rican waters must maintain permits, licenses, and insurance as required by Costa Rican maritime authorities.

These permits and insurance policies are held by the individual tour operators and vessel owners.

Guanacaste Sailing Charters does not operate vessels and does not control the compliance status of independent operators, although we work with providers that represent themselves as properly licensed and insured.


8. Medical Conditions & Travel Insurance

Customers with existing medical conditions, mobility limitations, or health concerns should inform Guanacaste Sailing Charters at the time of booking.

Customers are strongly encouraged to carry travel medical insurance covering marine and adventure activities.

Participation in tours is done at the customer’s own risk and discretion.


9. Payments Policy

A booking fee is required to secure a reservation. The amount depends on the selected sailboat, catamaran, or tour operator.

Private Tours

For private sailing and catamaran tours, the remaining balance is generally due 30 days prior to the tour date, unless otherwise stated.

Certain operators may require full payment 30–45 days before the tour date, depending on the operator’s individual payment and cancellation policies. Customers will be informed of any different payment requirements before completing the booking.

Shared / Public Tours

For shared / public sailing and catamaran tours, payment requirements may be different because these tours are generally booked closer to the tour date and are subject to the availability and payment policies of each individual operator.

For bookings made more than 7 days before the tour date, the applicable booking fee and remaining balance requirements will be communicated at the time of booking.

For bookings made 7 days or less before the tour date, full payment may be required at the time of booking in order to secure the reservation.

For last-minute requests, including bookings requested one day before the tour or on the day of the tour, full payment is required before the reservation can be confirmed, and the booking is subject to real-time availability.

A reservation is not considered confirmed until the required payment has been received and Guanacaste Sailing Charters has confirmed the booking with the applicable tour operator.


10. Customer Cancellation Policy

Because reservations require coordination with tour operators and service providers, the following cancellation policies apply:

Private Tours

  • Booking fees are non-refundable.
  • Cancellations made 21 days or less before the tour date are non-refundable.
  • Cancellations made between 29 and 22 days before the tour date may receive a 50% refund, minus applicable bank, credit card, or PayPal processing fees.

Shared / Public Tours

  • Booking fees are non-refundable.
  • Cancellations made 8 days or more before the tour date will receive a full refund, minus applicable bank, credit card, or PayPal processing fees.
  • Cancellations made 7 days or less before the tour date are non-refundable.

Important – Peak Season

Cancellation and payment policies may vary during Peak Season, including Easter / Holy Week and the period beginning some days before Christmas through the end of the year and some days after new year.

During these periods, certain tour operators may apply different or stricter payment and cancellation policies. Any special conditions applicable to a specific reservation will be communicated to the customer before payment is made.


11. Limitation of Liability

To the maximum extent permitted by applicable law, Guanacaste Sailing Charters and its owners, associates, agents, and employees shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to:

  • Loss of enjoyment

  • Travel interruption

  • Emotional distress

  • Lost vacation time

  • Additional travel expenses

If Guanacaste Sailing Charters is found liable for any claim related to a booking made through this platform, our total liability shall not exceed the amount of the booking fee or commission paid to Guanacaste Sailing Charters for the reservation involved.


12. Indemnification

By using this website and booking services through Guanacaste Sailing Charters, you agree to defend, indemnify, and hold harmless Guanacaste Sailing Charters, its owners, employees, agents, and affiliates from any claims, damages, liabilities, losses, or legal expenses arising from:

  • Your participation in a sailing tour

  • Actions or negligence of the independent tour operator

  • Your violation of these Terms & Conditions

  • Your conduct during a tour or transportation service

  • Any claim brought by a third party related to your actions


13. Acceptance of Terms

By making a payment or confirming a reservation through Guanacaste Sailing Charters, the customer acknowledges that they have read, understood, and agreed to these Terms & Conditions.

Customers further acknowledge that:

  • Guanacaste Sailing Charters acts solely as a booking intermediary, and

  • The tour operator is solely responsible for the operation of the sailing tour and vessel.
